Terms and conditions
The following General Terms and Conditions shall apply to the business relationship between Jingobid Ltd , its internet platform www.Jingobid.com ('Jingobid') and our users. By using Jingobid, the user accepts the following General Terms and Conditions, as well as the rules of participation in Jingobid Auctions as described on the website www.Jingobid.com. Variations or alterations in the following Terms and Conditions shall only be binding upon Jingobid Ltd if agreed to in writing.
Any bidding advice or other written materials (for instance, 'Help' articles) posted on Jingobid are provided solely as suggestions and are not intended to be relied upon. Jingobid is not liable or responsible for any actions taken due to a user or other person having read or been told about such advice or other written materials.
Users must register with Jingobid in order to acquire Items and Bidpacks and to participate in Auctions. Registration is free and open to users from all countries. By signing up to Jingobid, users state that they are over 18 years of age. However, in order to acquire items, users must have a delivery address in one of the countries covered by Jingobid and its delivery partners, as detailed on the website.
Employees, shareholders and contractors of Jingobid Ltd and their next of kin are not eligible to register or participate in Jingobid Auctions under any circumstances. They are prohibited from attempting to influence the outcome of Auctions in any way. They are prohibited from providing any information beyond that available on the Jingobid website to bidders or potential bidders.
Jingobid's products and services are offered exclusively to private users and not to commercial resellers. Jingobid reserves the right to exclude commercial resellers from the participation in the Auctions and may close their user accounts.
Each user may register only once using their email and postal address (registration using PO Boxes or equivalents is not permitted). Only one user is allowed to register per household. Where multiple users are registered at one household, accounts may be closed with no refund. If the same person is found to be paying for multiple accounts, this is also considered a breach of the rules and may result in accounts being closed with no refund.
During the registration process, the user must choose a username. The username must not be offensive or be designed to mislead other users or otherwise infringe upon other users rights. If the username is found to be offensive, Jingobid reserves the right to modify it.
Jingobid reserves the right to temporarily or permanently disqualify a user, or disable their account. Users will be disqualified when in the reasonable opinion of Jingobid, a member has violated the laws or the rights of third parties. A user will be disqualified if such action will protect the rights of other users, or to prevent unauthorised manipulation or use of Jingobid. Examples of such unauthorised usage include (but are not limited to) use of unauthorised third-party bidding software or set up of multiple user accounts by the same individual. In case of a breach of these terms by a user, Jingobid reserves the right to withhold deliveries or refunds for bids. Jingobid also reserves the right to make a reasonable administration charge deductible for unused bids at its discretion. Furthermore, Jingobid reserves the right to limit the number of Auctions a user may participate in at its own discretion.
All payments are made via PayPal's online payment system and can be made by all major credit or debit cards or from a PayPal account. All payments are processed by PayPal and Jingobid does not access, store or use credit or debit card information or Paypal account details. Users must have a valid debit/credit card or a paypal account to make purchases.
The base currency for Jingobid is the Hong Kong Dollar. All prices, bids and bid increments are denominated in this currency. International users will see the converted price into their own currency, as determined by the delivery address specified by the user. All charges will be made in that currency at the prices displayed to the user. The exchange rate is fixed from day to day and may differ from current official exchange rates to account for local costs.
Bids must be purchased and paid for by users prior to online bidding in lift or Dropsales. Bids can be purchased in fixed packages at prices advised on the website. They may also be acquired in Bidpacks in Auctions. Acquired Bids are non-refundable.
Bids purchased in a Bidpack are credited to the user's account and can be used any time to bid in any type of Auction. Jingobid may offer users Bonusbids at no charge, which may only be valid only for a limited time and may have a slightly different functionality from regular bids. After the stated limited time for Bonusbids expires, they are removed from the users account and can no longer be placed. Any new Bonusbids received will extend the validity of existing Bonusbids. Refunds are not available for expired Bonusbids.
Bonusbids are credited to users for referrals once the referred person makes a purchase of a Bidpack. The referred person must be a new user.
Jingobid restricts the number of real items a user can win every month by preventing them from bidding after a certain number of monthly wins. This limit is clearly displayed in the users account page. At the end of every month that limit is cleared and the user is free to bid again.
Users can use Bids or Bonusbids to bid online in any live Auctions. Bids can be placed by clicking on the GoBid buttons. This deducts a Bid from the user's account. If the user has run out of Bids, they will start using Bonusbids in the same way.
The Bidboy automatic bidding assistant allows bidders to bid on an Auction even if they are not online at that time by setting levels at which they wish to participate. The user can read about how the Bidboy operates in the 'Help' section. The user is prohibited from using bidding software not authorised by Jingobid, and doing so will result in immediate disqualification from use.
With each Bid placed, the price of the item on which the user is bidding increases by the amount specified for the Auction. A bid submitted by the user constitutes an offer from that user to Jingobid to enter into a purchase contract for the item at the Auction price. A contract to purchase the item does not come into effect until the Auction is finished and the last bidder has followed all the steps in Section 8.
When the Auction is nearing its end, every Bid also extends the time of the Auction by 15 seconds. The Auction ends when the remaining time reaches zero - there are no more bidders willing to bid up the price. The user who made the highest (last) bid then wins the Auction. All other bids on the item expire and will not be refunded unless specifically stated in the relevant promotional offer. The winning bidder is determined based on the records in Jingobid's database and Jingobid's decision regarding who is the winning bidder shall be final. The winning bidder has the option, but not the obligation to purchase the item at the winning price by following steps described in Section 8.
Users can participate in Dropsales in two ways, either by using Bids or Bonusbids to join in the downward bidding at the Dropped Price, or by buying the item outright at the displayed price.
Items in Dropsales can be purchased by registered users for lower prices (the Dropped Price) than those displayed for, by using two Bids. The current Dropped Price can be viewed by clicking on the GoBid button. When this is clicked, the Dropped Price is dropped by the set increment specified in the Sale and displayed to the user for a short period as specified in the Sale. Two Bids are deducted from the user's account. The user has the option to purchase the item at the displayed Drop Price for a limited time by clicking the Buy Now button while the price is displayed. This ends the Dropsale and takes the user to the payment screen as described in Section 8.
If the user does not click on Buy Now within the specified time, the price is concealed again and he no longer has the option of buying the item at that price. Subject to having Bids available in the account, the user can at any time click the GoBid button to view the new Dropped Price and purchase at the lower price.
Viewing the item does not lock in availability to the user. If at any time while the user is viewing the item, another user decides to purchase the item before he has clicked on the Buy Now button, the Dropsale ends and he no longer has the option to buy the item at that price. Any bids used to view the price are not refunded.
The Dropped Price declines every time users view it by using Bids. If it should reach zero without anyone having bought the item, the Auction ends and the last user to view the Dropped Price has the option to acquire the item for zero cost (subject to paying the shipping charge only).
If a user has no more Bids in his account, but has Bonusbids, he may still view the Dropped Price and purchase the item in the same way as with Bids, except the Dropped Price will not drop further as a result of his viewing it. Using Bonusbids to view the Dropped Price deducts two Bonusbids from the user's account.
After an Auction or Dropsale has ended, the winning bidder is taken to a payment screen. Here, information such as total price including shipping costs and payment options will be displayed. The user must actively confirm and pay the total price (Auction end price plus shipping costs) for the win by following the steps indicated on that page. Once the winner has paid for the item, the purchase contract has been concluded. If an Auction win has not been confirmed and paid within 21 days of the Auction end date, Jingobid reserves the right to withdraw the offer to conclude a contract and the winner's right to pay for and receive delivery of the item will be permanently revoked. In this instance, the bids placed in that Auction are non-refundable.
The item will not be sent to the user until the total price has been paid to Jingobid. In the event of PayPal or the credit card processors declining to accept payment by the user, Jingobid may at its discretion extend the 21 days that the user has to acquire the item, in order to allow them to organise payment. However Jingobid will not send out any items for which payment has not been taken from the user and will not refund any bids that may have been used in the Auction to acquire the item.
An invoice containing the Auction price and shipping costs will be sent to the user by Jingobid once delivery has been arranged.
Unless otherwise stated, delivery will be made directly from our suppliers or from our warehouse to the delivery address provided by the user. Deliveries can only be made to mainland USA, United Kingdom, France, Germany, Austria, Singapore, Macau and Hong Kong, although this list of countries will be expanded. Jingobid uses only established and reputable partners to provide the items and their delivery. These partners will vary depending on the country of shipping and the type of item. Jingobid aims to deliver within 10 working days of the purchase. If, against all expectations, Jingobid has not shipped the item within 10 working days of payment being made for the item, for reasons within Jingobid's control, the buyer is entitled to request a full refund of the price paid as well as any bids used in acquiring the item. Jingobid will not be liable for any damages or losses suffered from delayed delivery, beyond a full refund of payment.
All items sold by Jingobid are brand new, original and from reputable manufacturers. If an item is defective on arrival in a way that does not meet the manufacturers standards, the user can either contact the manufacturer directly for repairs or replacement under warranty, or contact Jingobid within 5 working days of receiving it, via the appropriate form on the website. Jingobid will either replace the defective item on its return to Jingobid or ensure that a replacement or repair is made by the manufacturer. Any damage or alterations caused by the user, that would void the manufacturer's warranty also void the right to return the goods to Jingobid.
If a purchaser changes their mind within 10 working days of having purchased the item (cooling-off period), they are entitled to return the product for a refund of the purchase price. The product must still be boxed and unopened, in a condition to be resold as new. Any bids used in bidding for the item will not be refunded. Prior to returning an item under the cooling-off period, the user must contact Jingobid via the appropriate form on their account page.
If an item does not match the description provided by Jingobid, the user is entitled to send it back for a replacement provided it is in the original packaging and in good condition. Prior to returning a defective or differing item, the user must contact Jingobid via the appropriate form on their account page within 5 working days of receiving it.
Sets/boxes can only be returned in their entirety and all original packaging and items must be included on any return.
All items sold by Jingobid are new, in manufacturer's packaging and with full local manufacturer warranties. The duration of the warranty will vary depending on the product. Should an item break down within the warranty period, the user should contact the manufacturer directly for repair and replacement. If necessary, Jingobid will assist the user in making that claim. If a product is sold without warranty for a particular country, this will be stated clearly in the product description.
Jingobid shall not be liable to the user for:
In particular, Jingobid shall not be liable for computer or internet connection problems during bid placement.
Jingobid shall not be liable for any losses arising from the user's subsequent use or misuse of the item including (without limitation):
Liability for damage arising from loss of life and limb, health, or well-being, as well as that according to product liability shall not be affected. These terms and conditions shall not affect a user's statutory rights regarding the return of defective goods and claims in respect of losses caused by any negligence on the part of Jingobid.
A system outage has occurred if no Bids can be submitted for items due to an unforeseeable disruption in the system. In such a case, Auctions that end during the disruption will be taken down, all Bids that were previously placed on these Auctions will be refunded to participating users and the Auction will be rescheduled on a different day. Any money paid for an Auction that ended during a system outage will be refunded.

In addition, but not subject to, the provisions of clause number 10, Jingobid shall not be liable for any damage whatsoever incurred by Auction users or third parties from using Jingobid's services.
